warranty policy

Tecalemit, Inc. (“Seller”) warrants to Buyer that all equipment or parts thereof manufactured by it will be free from defects in material and workmanship only, under normal use and service, for a period of two years from the date of original shipment.

This warranty shall not apply to any equipment or parts thereof which have been subjected to damage, abuse, neglect, misuse, operation other than in accordance with the manufacturer’s operating instructions and conditions, or alteration outside the seller’s instruction.

This Warranty does not extend to products or components not manufactured by the Seller but furnished as part of its equipment (for example: motors, starters, thermometers, controls, etc.). For such products and components Seller conveys to Buyer the warranty, if any, of Seller’s suppliers, to the extent transferable without additional cost to Seller.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED (INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) and of all other obligations or liabilities on the part of the Seller, and the Seller will neither assume nor authorize any other person to assume for it any other obligation or liability in connection with this equipment. Seller’s liability shall be limited to the purchase price of this equipment.

The Seller shall not be liable for any loss of profit, loss by reason of plant shutdown, non-operation or increased cost of operation, loss of product or materials, or other special or consequential loss or damages. Seller’s sole obligation under the foregoing warranties will be limited to, at Seller’s sole discretion, either repairing or replacing the defective goods, or, if deemed appropriate by the Seller, crediting the purchase price of the defective goods. If the product is no longer available, replacement may be made with a similar product of equal or greater value. Buyer’s exclusive remedy for breach of any such warranties will be enforcement of such obligations of the Manufacturer.

Charges for shipping and insuring packages to Tecalemit, Inc. are Buyer’s responsibility. Tecalemit, Inc. will ship warrantied product back to the customer via ground shipping at no charge for shipments within the contiguous United States. International shipping charges and customs fees to and from Tecalemit, Inc. are Buyer’s responsibility.

The Buyer’s acceptance of delivery of equipment constitutes acceptance of this warranty policy and all conditions and limitations thereof.
